The family of an ex-model who was killed in a gruesome murder-suicide by her professional wrestler husband is locked in a court battle with Hustler Magazine over its decision to publish nude photos of the woman. Lawyers for the smut mag argued in an Atlanta court on Wednesday that the First Amendment protected their right to publish the racy pics of Nancy Benoitwife of former WWE star Chris Benoitafter she and her son were murdered in because she was deemed newsworthy. Chris Benoit, 40, strangled his wife and their son, Daniel, in their Atlanta-area home on June 22,placed Bibles next to their bodies, then hanged himself using a weight machine.

Washington CNN -- The Supreme Court has decided that the family of a slain professional wrestling personality can continue its lawsuit against Hustler magazine, a case that tested privacy concerns and the competing right to publish "newsworthy" material. The justices without comment Monday turned aside an appeal from the publishers of the men's magazine, which featured old nude photos of Nancy Benoit, who was killed nearly three years ago by her husband and fellow wrestling superstar Chris Benoit. The couple's young son also was slain in the family's Georgia home.
